Information For Food Donors

By donating to Loving Spoonful you reduce the amount of waste your company sends to landfill. Products which are still safe for consumption after pick-up will be stored at the Partners in Mission Food Bank and transported by our employees and volunteers to agencies that feed the hungry in Kingston.

We accept: surplus fresh produce, frozen prepared food, left-over fruit and vegetable plates, sandwich trays, soups, meat, deli products, juice, and mislabeled, close to code and discontinued products still safe for consumption. Contact us to help you assess what you can donate.

Why donate to Loving Spoonful?

  • This is a free, socially and environmentally responsible way to deal with food surplus in your organization.
  • Your organization is covered under the Ontario Donation of Food Act (below), passed in 1994 to remove liability from any director, agent, employee, or volunteer of a corporation that donates or distributes food to another agency.
  • Our employees are trained in the safe handling of perishable food.
  • There is no cost to your organization – our employees and volunteers will sort, handle, transport and store your surplus perishable produce free of charge to you.

How can you become involved?

  • Contact Susan at 613.583.2055, or susan [at] lovingspoonful [dot] org to set up pick-up times for drivers to collect donations.
  • Store food to be donated in a manner that keeps it fit for consumption.
  • Our volunteers and employees will do the rest!

Donation of Food Act, 1994

S.O. 1994, CHAPTER 19

No Amendments.

Liability of donor

1.  (1)  A person who donates food or who distributes donated food to another person is not liable for damages resulting from injuries or death caused by the consumption of the food unless,

(a) the food was adulterated, rotten or otherwise unfit for human consumption; and

(b) in donating or distributing the food, the person intended to injure or to cause the death of the recipient of the food or acted with reckless disregard for the safety of others. 1994, c. 19, s. 1 (1).

Liability of director, agent, etc.

(2)  The director, agent, employee or volunteer of a corporation that donates food or that distributes donated food is not personally liable for any damages resulting from injuries or death caused by the consumption of the food unless,

(a) the food was adulterated, rotten or otherwise unfit for human consumption; and

(b) in donating or distributing the food, the director, agent, employee or volunteer,

(i) did not act in good faith,

(ii) acted beyond the scope of his or her role as director, agent, employee or volunteer, and

(iii) intended to injure or to cause the death of the recipient of the food or acted with reckless disregard for the safety of others. 1994, c. 19, s. 1 (2).

Non-application

2.  This Act does not apply to a person who distributes donated food for profit. 1994, c. 19, s. 2.
